Documents conflict on when Romney left Bain

WASHINGTON (AP) ? Documents filed by Mitt Romney's former company conflict with the Republican presidential candidate's statements about when he gave up control of the private equity firm Bain Capital. President Barack Obama's campaign seized on the discrepancies Thursday to charge that Romney was lying about his background.

Romney, in turn, said Obama was the one being dishonest, rolling out a hard-hitting television ad that accused the president of launching "misleading, unfair and untrue" attacks about the Republican's role in outsourcing U.S. jobs.

"When a president doesn't tell the truth, how can we trust him to lead?" the narrator says in the Romney ad titled "No Evidence."

Obama has accused Romney of being an "outsourcing pioneer" who invested in companies that shipped jobs to China, India and elsewhere overseas. But Romney, who has made his business experience the central part of his candidacy, claims he had no role in outsourcing U.S. jobs because much of that activity didn't happen until after 1999, when he says he had given up operational control at Bain.

Both candidates dug in on their positions, dispatching aides to level deeply personal criticisms aimed at casting each opponent as little more than a typical politician. Each candidate is seeking to sully his rival's integrity in hopes of gaining ground in closely contested campaign four months before Election Day. But the strategy carries risks: It could alienate voters ? especially critical independents ? who are turned off by negative campaigning and want to see the candidates focus on the economy and job growth.

At issue is when Romney left Bain, and whether he was at the helm when it sent jobs overseas.

The documents, filed with the U.S. Securities and Exchange Commission, place Romney in charge of Bain from 1999 to 2001, a period in which the company outsourced jobs and ran companies that fell into bankruptcy.

Romney has tried to distance himself from this period in Bain's history, saying on financial disclosure forms he had no active role in Bain as of February 1999. Obama has labeled Romney a job killer in hopes of undercutting the Republican's claim that his private business experience gives him the ability to turn around the struggling economy.

But at least three times since then, Bain listed Romney as the company's "controlling person," as well as its "sole shareholder, sole director, chief executive officer and president." And one of those documents ? as late as February 2001 ? lists Romney's "principal occupation" as Bain's managing director.

The Obama campaign called the SEC documents detailing Romney's role post-1999 a "big Bain lie." And Obama deputy campaign manager Stephanie Cutter said the presumptive GOP nominee may have even engaged in illegal activity.

"Either Mitt Romney, through his own words and his own signature, was misrepresenting his position at Bain to the SEC, which is a felony," Cutter said, "or he is misrepresenting his position at Bain to the American people to avoid responsibility for some of the consequences of his investments."

Countering, Romney campaign manager Matt Rhoades said Cutter's comments marked "a new low" in the campaign and called on the president to apologize for "the out-of-control behavior of his staff, which demeans the office he holds."

After weeks of Bain attacks by Obama, Romney rolled out his new ad alleging dishonesty ? a signal that the Democratic criticism may be hurting him.

The ad sought to establish dishonesty as a pattern for Obama, and uses his 2008 Democratic primary rival, Hillary Rodham Clinton, to do it. It included a clip of Clinton ? now serving Obama as secretary of state ? saying, "Shame on you, Barack Obama" and calling on her then-challenger to stop running dishonest ads.

Even as it sought the upper hand with the ad, Romney's campaign found itself scrambling to explain the apparent discrepancies between the former Massachusetts governor's past statements about his Bain tenure and the SEC documents.

Campaign spokeswoman Andrea Saul insisted Romney left Bain in February 1999 and "had no input on investments or management of companies after that point."

The campaign also issued a statement from Bain saying that "due to the sudden nature of Mr. Romney's departure, he remained the sole stockholder for a time while formal ownership was being documented and transferred to the group of partners who took over management of the firm in 1999. Accordingly, Mr. Romney was reported in various capacities on SEC filings during this period."

The SEC documents ? which have received modest attention despite being reported in recent days by publications including the political website Talking Points Memo ? raise questions about Romney's role at Bain in 1999, 2000 and early 2001. If he turned his full attention to the Olympics in early 1999, as his campaign says, it's hard to square with the Bain SEC filing, two years later, listing his "principal occupation" as the company's managing director and his titles as CEO and president.

James Cox, a securities law professor at Duke University, said the SEC's Schedule 13D forms have always been under legal scrutiny by SEC officials and company executives. He said law firms hired to file such reports ? known as "beneficial ownership reports" because they deem who can sell securities ? "pay great attention to these forms. I don't find that these parts of the documents are casually reported."

"It's hard for me to believe you could be listed as 'management anything' without it taking up a bulk of your time," said Cox, who had not reviewed Bain's statement on Thursday.

During the years in question ? 1999 to 2011 ? Bain oversaw investments that either sent jobs abroad of filed for bankruptcy. For example, in late 1999, Bain-controlled Steam International set up overseas call centers, and a subsidiary moved jobs from California to Mexico. In 2000, the Ampad company declared bankruptcy. The following year, so did steel-maker GS Industries ? just as Bain made $58.4 million from its investment.

The Obama campaign has used workers laid off from Ampad in attacks on Romney's business record.

Romney helped found Bain Capital in 1984. The private equity firm invested in various companies, often restructuring their management and operations. Some became success stories that hired new workers and enriched Bain's investors. Others struggled or went out of business. Romney made millions of dollars and cites Bain as chief proof that he understands private enterprise and job-creation.

Romney eventually negotiated a retirement agreement with Bain Capital in 2002. The agreement was made retroactive to February 1999.

The Boston Globe reported Thursday that a Massachusetts financial disclosure form Romney filed in 2003 stated he still owned 100 percent of Bain Capital in 2002. Romney was elected to one term as Massachusetts governor in 2002.

The Bachelorette Recap: Who Made the Final Two?


If The Bachelorette star Emily Maynard felt that her decision to cut Chris loose after last week's hometown dates was hard, this one was near impossible.

Things got even more serious, emotional and dramatic in Curacao as Emily went on very romantic dates with Arie Luyendyk, Jr., Sean Lowe and Jef Holm.

Three worthy candidates, only two roses in play. Who would she pick? And how would she handle the fantasy suite card situation, given that she's a mom?

Jef quasi-rebuffs the Fantasy Suite invite before Emily can do it to him. Guy's been playing hard to get from the get-go. Interesting tactic. Plus 7.

"There is a time and a place for everything, and now is the time to bridle these passions." Very mature move, but who talks like that? Minus 14.

"My connection with Arie was literally almost immediate." - Emily. That makes literally almost no sense, but we totally get it, so Minus only 3.

Swimming with the dolphins looks awesome. But not as much as kissing, which is all they seem to do. All of his "top moments" involve kissing. Hey, they're both good at it. Who wouldn't want to make out with either of them? So Plus 11.

Ah, but back to reality ... what does Arie Luyendyk, Jr. do on a Tuesday morning?! No one knows! Minus 10, because physical chemistry and dream dates will only carry you so far, even on The Bachelorette. Jef may have the edge as a result.

Arie sleeps until 9 and goes out to dinner every night? Not exactly stepfather stuff ... but he does seem legitimately interested in Ricki, so Plus 7.

Emily makes Arie feel like a natural man. Or something. Plus 3?

He's SO good looking ... Emily won't give him the fantasy suite card because she doesn't trust herself! The Bachelorette: Mom Edition definitely lacks the sleaze factor of past seasons. Plus 25, even if it's sometimes less entertaining.

The discovery of a new subatomic particle that is likely the elusive Higgs boson ? a particle thought to give all other matter its mass ? could be an important step toward uncovering the invisible stuff that makes up the majority of the universe, physicists say.

In a much-hyped announcement yesterday (July 4) from the world's largest atom smasher, the Large Hadron Collider in Switzerland, scientists reported evidence of a new "Higgs-like" particle with roughly 125 times the mass of the proton.

The researchers claimed a high level of certainty that the new particle is the long-sought Higgs boson, which is thought to answer how all other matter has mass. The long-sought-after Higgs is the missing link in the reigning theory of particle physics, known as the Standard Model, but finding the Higgs has even wider implications: It opens the door beyond the Standard Model for explaining the existence of dark matter, the mysterious substance widely thought to make up 83 percent of all matter in the universe.

Dark matter has yet to be directly detected; its presence is inferred based on its gravitational pull. Confirming the characteristics of the newly found Higgs-like particle could account for dark matter.

While dark matter is not explained as part of the Standard Model, evidence for the enigmatic substance (based on its gravitational effects) is hard to ignore. This could mean the Standard Model is only part of a wider framework to explain the universe, said Harvey Newman, a professor of physics at the California Institute of Technology. "We can't really deny the existence of dark matter," Newman told SPACE.com from the European Organization for Nuclear Research, or CERN, in Geneva. "The Higgs particle that we found doesn't prevent us at all for searching for particles that lie beyond the Standard Model. We still need a candidate for dark matter."

If the newfound particle is consistent with the Standard Model, physicists may be able to use these results to craft a more encompassing picture of the universe.

"You can think of what we found as the key part of the genetic blueprint of the universe," said Maria Spiropulu, another Caltech physics professor of physics, who was in the audience at the July 4 announcement in Switzerland.

Matthew Stafford One Of NFL's Top Stars Under 25 To Build Around, According To ESPN

ESPN's KC Joyner recently put together a list of the top 10 NFL players under 25 that you would want to build a franchise around. A number of the players on the list are quarterbacks, including the Detroit Lions' Matthew Stafford. He came in at No. 2 on the list, one spot behind Philadelphia Eagles running back LeSean McCoy.

Here's Joyner's reasoning for having the 24-year-old Stafford near the top of the list:

Pros: Stafford racked up more than 5,000 passing yards last season despite throwing more than 75 percent of his targets to guys like Brandon Pettigrew, Nate Burleson, Titus Young and Tony Scheffler. Having Calvin Johnson as a primary target is a big help, but those numbers illustrate Stafford has an ability to post voluminous numbers even when throwing to less-than-elite pass-catchers.

Cons: He has had only one healthy NFL season, something that shows Stafford still has a ways to go to prove his long-term durability.

Before Stafford joined the Lions, the only real weapon on offense was Johnson. Since then, Martin Mayhew has spent a lot of time building around Stafford by adding guys like Pettigrew, Burleson, Young, Scheffler, Jahvid Best and Mikel Leshoure. Once you find that "cornerstone" player, it's important to surround him with talent, and the Lions have certainly done a good job of that with Stafford.

Homes MSP Real Estate Blog: We Like Windsor Green!

We moved to Windsor Green one month ago, and we already love it here!

This is our Top Ten list:??

  1. Our new friends and neighbors:? everyone has been friendly and inviting; neighbors have stopped by to say hello and welcome us to the ?hood; some brought flowers and food!
  2. The lovely park-like setting: it?s a joy to sit on our front deck to enjoy the breeze, the birds, and lovely grounds with mature trees; our granddaughter has already met and played with new friends, and we can sit on the deck and watch them play.
  3. The walking trails:? over two miles of trails, right here in Windsor Green;? many people walk The Green every day.
  4. The swimming pools (2!):? a great place to meet neighbors and a place for grandchildren when they visit; one of the elder residents who is close to 90 swims laps every morning!? Swimming lessons for children and grandchildren) have been held at the pool for over 20 years!
  5. Accessibility, events and classes at Silverwood Park:? a part of the Three Rivers park system, Silverwood is a hidden gem, right off Silver Lake Road.
  6. Close to shopping and freeways:? quick access to 694, 35W & Hwy 36
  7. Close to Minneapolis and St Paul;? about 15 minutes to either downtown
  8. Women?s group:? Women Who Cook and Women Who Walk:? I joined this group the second week we lived here and instantly met 19 new friends!
  9. Men?s group:? Men Who Dine Out (on the nights their women are cooking!): John
    met new friends that same night
  10. The diversity:? families of all ages live here, making this a place that is both peaceful yet energetic; there?s always something happening, and the association keeps us well-informed and connected.
